Ifrah Law’s Rachel Hirsch Discusses the New Era of Affiliate Marketing in New Webinar

There are shifting trends in enforcement that affiliate marketers face in the Post-Trump era.

— As America ushers in a new political administration, the rules and regulations that dictate the tactics of marketers are changing, as are the ways that the federal government is enforcing them. In a webinar hosted with Integrishield, Rachel Hirsch, Senior Associate with Ifrah Law, discussed the shifting trends in enforcement that affiliate marketers face in the Post-Trump era and the importance of compliance and best practices to protect against liability.

Ms. Hirsch, the winner of The Daily Record’s 2016 Leading Women Award, focuses her practice on online marketing and advertising, e-commerce, civil litigation and white collar criminal defense, with a particular emphasis on FTC and State AG enforcement.

In The Blame Game: A New Era of Affiliate Marketing, Ms. Hirsch addressed the Trump administration’s stance on federal regulatory enforcement, the new threats facing marketers in 2017, and real-world measures that can be taken to help mitigate exposure to liability. “Even if the Trump administration seeks to curb new regulations,” said Ms. Hirsch, State AGs will likely step in to fill any void created in enforcement efforts by federal agencies that may be affected by Trump’s new pro-business policies.”

“Don’t be fooled by a perceived down-tick in federal regulatory enforcement,” warns Ms. Hirsch, “continue implementing compliance procedures and best practices to protect against increased scrutiny from states and private plaintiffs.” In an era when consumers are more educated and legal and social pressure is higher than ever, Ms. Hirsch’s webinar advised marketers to institute best practices and hold their advertising partners accountable in order to limit their exposure liability and protect their interests.
